General Terms and Conditions

Article 1 - Definitions In these terms and conditions, the following definitions apply:

  • Cooling-off period: The period within which the consumer can exercise their right of withdrawal.
  • Consumer: A natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur.
  • Day: Calendar day.
  • Long-term contract: A distance contract relating to a series of products and/or services, for which the delivery and/or performance obligations are spread out over time.
  • Durable data carrier: Any medium that enables the consumer or entrepreneur to store information personally addressed to them, in a way that allows future consultation and unchanged reproduction of the stored information.
  • Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.
  • Entrepreneur: The natural or legal person who offers products and/or services remotely to consumers.
  • Distance contract: A contract whereby in the context of a system organized by the entrepreneur for the remote sale of products and/or services, communication techniques are exclusively used for the conclusion of the contract up to the moment of the agreement.
  • Communication technique: A method that can be used to conclude an agreement without the consumer and entrepreneur being in the same physical location.
  • Terms and Conditions: These general terms and conditions of the entrepreneur.

Article 2 - Right of Withdrawal The consumer has the right to withdraw from the agreement within a cooling-off period of 14 days without providing a reason.
During the cooling-off period, the consumer must handle the product and packaging with care.
If the consumer exercises their right of withdrawal, they must return the product with all delivered accessories and, if possible, in its original condition, according to reasonable instructions from the entrepreneur.

Article 3 - Applicability These terms and conditions apply to all offers made by the entrepreneur and to any distance contracts and orders between the entrepreneur and consumer.
Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be stated before the distance contract is concluded that the terms and conditions are available for inspection at the entrepreneur’s premises and will be sent free of charge at the consumer’s request as soon as possible.

Article 4 - The Offer If an offer has a limited validity period or is subject to conditions, this will be clearly stated in the offer. The offer is non-binding.
The entrepreneur is entitled to modify and adjust the offer. The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to allow the consumer to make a good assessment of the offer. If the entrepreneur uses images, they must represent the products and/or services truthfully. Any obvious mistakes or errors in the offer do not bind the entrepreneur.

Article 5 - The Agreement The agreement comes into force when the consumer accepts the offer and meets the conditions set forth.
If the consumer accepts the offer electronically, the entrepreneur will confirm receipt of the acceptance electronically.
Until the entrepreneur has confirmed receipt, the consumer may withdraw from the agreement.

Article 6 - Right of Withdrawal In the case of product purchases, the consumer has the right to dissolve the agreement within 14 days.
This period starts the day after the consumer has received the product or has designated a representative.
During the cooling-off period, the consumer must handle the product and packaging carefully. The product can only be unpacked or used to the extent necessary to assess whether the consumer wishes to keep the product.

Article 7 - Costs in Case of Withdrawal If the consumer exercises their right of withdrawal, the costs of returning the product are borne by the consumer.
If the consumer has made a payment, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after withdrawal, provided the product has been returned or proof of return is provided.

Article 8 - Exclusion of the Right of Withdrawal The entrepreneur may exclude the right of withdrawal for products such as:

  • Products made according to the consumer’s specifications.
  • Products that are clearly personal in nature.
  • Products that cannot be returned due to their nature.
  • Products that can spoil or expire quickly.
  • Audio and video recordings or computer software where the consumer has broken the seal.

Article 9 - The Price During the validity period specified in the offer, the prices of the offered products and/or services will not be increased, except for price changes due to changes in VAT rates.
Price increases within 3 months after the agreement is concluded are only allowed if they result from legal regulations or provisions.
Price increases after 3 months are only allowed if agreed upon by the consumer.

Article 10 - Conformity and Warranty The entrepreneur ensures that the products and/or services comply with the agreement, the specifications mentioned in the offer, and the reasonable requirements of quality and/or usability.
Any defects or incorrectly delivered products must be reported to the entrepreneur in writing within 14 days after delivery.

Article 11 - Delivery and Execution The entrepreneur will exercise the utmost care in accepting and executing orders for products.
Accepted orders will be executed as soon as possible, but no later than 30 days unless otherwise agreed.

Article 12 - Long-Term Contracts: Cancellation and Extension Cancellation: The consumer can cancel a long-term contract for the regular delivery of products or services at any time, adhering to the cancellation rules and a maximum notice period of one month.
Extension: A contract for a specific period that involves the regular delivery of products or services cannot be automatically extended for a fixed period, except for newspapers, magazines, and similar publications.

Article 13 - Payment Unless agreed otherwise, the amounts owed by the consumer must be paid within 7 days after the cooling-off period begins.
In case of non-payment, the entrepreneur may charge reasonable costs.

Article 14 - Complaints Procedure Complaints about the execution of the agreement must be submitted fully and clearly within 7 days after the consumer has noticed the defects.
Complaints submitted to the entrepreneur will be answered within 14 days of receipt.

Article 15 - Disputes Only Dutch law applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply, even if the consumer resides abroad.
